Terms of Use of the HolaOlas Platform
Simple summary: HolaOlas provides a tool to create, manage and display experiences and their bookings, with no commission. By using the platform, you agree to the rules below.
1) Role of HolaOlas
- HolaOlas is a technology platform enabling experience creators to create, manage and display their offerings.
- HolaOlas does not organize, produce, sell or supervise any experience offered on the platform.
- Experiences are created, published and operated exclusively by their respective providers.
2) Service
- Platform for creating and managing experiences and bookings.
- HolaOlas may evolve the service for technical, legal or security reasons.
3) Accounts, content and responsibilities
- You provide accurate information and protect your credentials.
- You are solely responsible for the content published and its accuracy.
- By publishing an experience, you declare and warrant:
- • that you are legally authorized to offer this experience,
- • that you have the required licenses, permits, authorizations,
- • that you hold the necessary insurance,
- • that you comply with applicable tax and regulatory obligations,
- • that you assume full responsibility for the safety of participants.
- HolaOlas does not perform any prior verification on the legality or compliance of published experiences.
4) Display of experiences on HolaOlas
- Experiences displayed on the HolaOlas website are for informational and promotional purposes.
- Each experience is offered by an independent creator, who assumes full responsibility for it.
5) Bookings and payments
- Payments are processed via Stripe. HolaOlas does not store card data.
- Unless explicitly stated otherwise, payments are made to the creator, via their own Stripe account.
- You manage your pricing, availability, cancellation and refund policies.
- HolaOlas does not collect funds on behalf of creators and does not act as a seller of the experience.
6) Cancellations / modifications / disputes
- Cancellation and refund terms are defined by the creator.
- In case of dispute, the participant and creator agree to seek an amicable solution before any action.
7) Acceptable use
- Prohibition of illegal use, fraud, spam or security breaches.
- Prohibition of violation of third-party rights (intellectual property, privacy, etc.).
8) Moderation, suspension and content removal
- HolaOlas reserves the right to suspend or remove any experience, account or content, without notice, particularly in case of:
- • complaint or report,
- • reasonable doubt about legality, safety or compliance,
- • non-compliance with these terms.
- This removal does not constitute any acknowledgment of liability on the part of HolaOlas.
9) Limitation of liability
- The service is provided "as is". HolaOlas does not guarantee complete absence of interruptions.
- To the extent permitted by law, HolaOlas shall not be held liable for any damage, accident, loss or dispute resulting from an experience offered by a creator.
- Where permitted by law, HolaOlas's liability is limited to the amount paid for the relevant service.
10) Modifications and termination
- HolaOlas may update these terms and will inform you of significant changes.
- You may stop using the service at any time. Your obligations already incurred remain due.
11) Applicable law and contact
- The applicable law and competent jurisdiction will be determined according to the place of establishment of the creator or the entity operating HolaOlas.
